These Terms of Service (“Terms”) govern your access to and use of our web applications, proposal studios, Smart Rate Engine, itinerary generation tools, and related services (collectively, the “Platform”). By creating an account, accessing, or using Modern Safaris, you agree to be legally bound by these Terms.
1. Platform Scope & Operator Accounts
Modern Safaris provides a specialized software-as-a-service (SaaS) platform for tour operators, destination management companies (DMCs), travel agencies, and safari guides. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
- Accounts may only be registered by authorized representatives of legal businesses or registered operators.
- You agree to provide accurate, current, and complete organization details during registration.
- You must notify Modern Safaris immediately upon discovering any breach of security or unauthorized access.
2. Operator Duty to Verify Rates, fees & Proposals
Modern Safaris equips operators with automated tools, pre-loaded lodge rate structures, seasonal tariff calculations, and national park fee databases to streamline quote generation.

You are solely responsible for independently verifying all rate calculations, lodge fees, park entry fees, conservation levies, single supplements, exchange rates, and day-by-day itinerary details before sending proposals to clients or confirming bookings. Modern Safaris makes no warranty that pre-calculated rates or automated estimates are free from third-party vendor updates, pricing changes, or manual input discrepancies.
Under no circumstances shall Modern Safaris be liable for pricing errors, margin losses, underquoted proposals, or customer disputes arising from unverified proposals transmitted to guests.
3. Subscriptions, Fees & Billing
Access to Modern Safaris is provided on a subscription basis (billed monthly or annually) or under custom enterprise agreements.
- Billing & Renewal: Subscriptions automatically renew at the end of each billing cycle unless cancelled prior to the renewal date.
- Fee Adjustments: We reserve the right to adjust subscription rates upon 30 days prior notice to operators.
- Refunds: Subscription payments are non-refundable except where explicitly required by applicable law or written agreement.
4. Intellectual Property & Branding
Modern Safaris retains all rights, title, and interest in the Platform, underlying software code, database architecture, design systems, and trademarks.
Your Content & Proposals: You retain ownership of all client data, custom tour descriptions, images, logos, and custom proposal media uploaded to your account. You grant Modern Safaris a limited license to host, store, display, and format your content solely to deliver Platform services.
5. Service Availability & Modifications
We strive to maintain high availability for your web proposal links and operator dashboard. However, scheduled maintenance, system upgrades, or emergency security patches may occasionally result in temporary downtime.
Modern Safaris reserves the right to modify, update, or enhance features of the Platform at any time to improve system performance or security.
6. Limitation of Liability
To the maximum extent permitted by applicable law, Modern Safaris shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, client contracts, or data loss arising out of or in connection with your use of the Platform.
7. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Tanzania and applicable regional regulations, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved primarily through good-faith negotiation.
